Section 34AB Category VIII — The Specific Registration That Makes the Certificate Authoritative
Section 34AB of the Income Tax Act, 1961 provides for the registration of valuers under specific asset categories by the Principal Chief Commissioner of Income Tax. Since the registration is category-specific, only a valuer registered under Category VIII – Works of Art is authorised to issue Government Approved Art Valuation Certificates for paintings, sculptures, drawings and other works of art.
Category VIII
Works of Art Authorised Registration for Government Approved Art Valuation.
Understanding the Difference Between Category VII & Category VIII
Under Section 34AB of the Income Tax Act, registrations are issued for specific asset classes. While Category VII covers jewellery, Category VIII specifically authorises valuation of Works of Art. The distinction is fundamental because Rule 11UA(1)(a) recognises only the appropriate category for determining the Fair Market Value of the relevant asset.
Category VII
Jewellery
Section 34AB Category VII covers jewellery, ornaments, precious metals and articles set with precious stones. It is a separate statutory registration from Works of Art.
- Jewellery
- Precious Stones
- Ornaments
- Luxury Articles
Category VIII
Works of Art
Section 34AB Category VIII authorises the valuation of paintings, sculptures, drawings, prints, photographs and other works of art and is the registration recognised by Rule 11UA(1)(a).
- Paintings
- Sculptures
- Drawings
- Works of Art
Why the Category VIII Registration Makes the Art Valuation Certificate Statutorily Valid
A Section 34AB registration is not a general licence to value every asset. Since registrations are issued for specific categories, only a Category VIII – Works of Art Registered Valuer is authorised to certify the Fair Market Value of paintings, sculptures and other works of art under Rule 11UA(1)(a).
Artwork
A painting, sculpture or other Work of Art requires valuation.
Category Check
The first statutory requirement is verification of the Section 34AB Registration Category.
Category VIII
Only Category VIII – Works of Art is recognised for Rule 11UA(1)(a).
Certificate
A Government Approved Art Valuation Certificate with statutory standing.
Registration Under Section 34AB Category VIII Requires More Than Experience
Registration under Section 34AB, Category VIII – Works of Art is granted only after satisfying the prescribed eligibility requirements before the Principal Chief Commissioner of Income Tax. The registration recognises both professional competence and specialised valuation expertise for works of art.
