Rule 11U & Rule 11UA The Statutory Methodology for Art FMV

The Fair Market Value (FMV) of a Work of Art is not merely an opinion of value. Under the Income Tax Rules, 1962, Rules 11U and 11UA prescribe the legal framework governing the determination of FMV. Every Government Approved Art Valuation Certificate must document the statutory methodology, the valuation basis and the professional reasoning adopted by the Section 34AB Registered Valuer.

Every certificate is prepared in accordance with Rule 11U and Rule 11UA(1)(a) by a Section 34AB Registered Valuer.

RULE 11U • FAIR MARKET VALUE

Rule 11U Defines the Fair Market Value Standard

Under Rule 11U of the Income Tax Rules, 1962, the Fair Market Value (FMV) means the price that a property would fetch if sold in the open market on the valuation date. Every Government Approved Art Valuation Certificate applies this legal standard before arriving at the final valuation conclusion.

Willing Buyer & Seller

The valuation assumes a transaction between a willing buyer and a willing seller, with neither party acting under pressure or compulsion.

Valuation Date

The Fair Market Value is determined only for the specified valuation date, not an earlier, later or average market price.

Open Market

The value reflects an arm's-length transaction in the open market, excluding forced sales or related-party pricing.

The objective of Rule 11U is to determine the price a Work of Art would reasonably fetch in the open market on the specified valuation date using accepted professional valuation principles.
RULE 11UA(1)(a)

The Statutory Methodology for Determining the Fair Market Value of a Work of Art

Rule 11UA(1)(a) specifically prescribes the methodology for determining the Fair Market Value of jewellery, archaeological collections, drawings, paintings, sculptures and any work of art. The Rule requires the value to be estimated by a Section 34AB Registered Valuer in the relevant asset category.

Valuation begins with a Section 34AB Registered Valuer holding the appropriate asset category registration.

Analysis of auction records, market transactions, gallery references and comparable sales.

Professional Judgement

Adjustments are made for condition, provenance, authenticity, rarity and valuation date.

FMV Certificate

A Rule 11UA(1)(a) compliant Fair Market Value Certificate is issued with the final valuation conclusion.

The phrase "value as estimated by a Registered Valuer" under Rule 11UA(1)(a) delegates the Fair Market Value determination to the professional judgement of a Section 34AB Registered Valuer, applied within the Open Market Value standard prescribed by Rule 11U.

RULE 11UA(2)

Rule 11UA(2) — FMV for Receipts at Inadequate Consideration

Rule 11UA(2) applies where a Work of Art is acquired for a price lower than its Fair Market Value. Whether the asset is received as a gift or purchased at an undervalued consideration, the valuation must be supported by a Section 34AB Registered Valuer's Certificate prepared in accordance with the Income Tax Rules.

Gift of Artwork

Where a painting, sculpture or other work of art is received without consideration, the Fair Market Value is determined under Section 56(2)(x) using the methodology prescribed by Rule 11UA(1)(a).

Where a Work of Art is acquired for a value below its Fair Market Value, Rule 11UA(2) provides the valuation framework for determining the tax implications of inadequate consideration.
